1. Introduction

These Terms and Conditions ("Terms") govern the use of the Emaly platform, operated by Emaly, located at Eewal 94A, 8911 GV Leeuwarden, Netherlands (KvK: 93788843), hereinafter referred to as “Emaly”, “we”, or “our”. By creating an account or using any part of our platform, you agree to be bound by these Terms.

2. User Eligibility

Emaly is intended for professional use only. You must be a registered business (e.g. KvK in NL or EU equivalent). Use by minors is strictly prohibited.

3. Services and Pricing

Emaly provides tools for event management including ticketing, CRM, POS, project planning, and more. There is no base fee to create a workspace. We charge a per-ticket service fee based on your active modules (via Mollie), and some modules are available via monthly subscriptions.

4. User Responsibilities

You are responsible for your login credentials and all activity under your account. Misuse, including money laundering, fraud, or criminal activity, may lead to immediate suspension.

5. User Content

You retain ownership of all content uploaded to your workspace. We only moderate content visible to the public, such as event listings in ticket shops. Harmful or illegal content may be removed.

6. Account & Workspace Termination

You may delete your workspace at any time. We may suspend or terminate accounts that violate these terms. Software usage statistics may be retained anonymously.

7. Third-Party Services

We use third-party services: Supabase, Redis, Heroku (infrastructure); Mollie (payments); Resend (email); and Plausible (analytics). Your use of Emaly implies consent to these integrations.

8. Liability & Warranty

Emaly is provided “as is”. We are not liable for outages, bugs, data loss, or indirect damages.

9. Modifications

We may update these Terms at any time. Users will be notified and must accept changes to continue using the platform.

10. Governing Law

These Terms are governed by Dutch law. Disputes will be settled in the competent court of the Netherlands.
